Terms of Service

Welcome to Shooting Club ("the Platform", "we", "us", or "our"). By accessing or using shootingclub.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

1. Acceptance of Terms

By creating an account or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. Permitted Use

2.1 Legal and Sportive Use Only

The Platform is intended exclusively for legal sporting shooting activities. You agree to:

• Use the Platform only for legitimate sporting shooting purposes
• Comply with all applicable local, national, and international laws and regulations
• Not use the Platform for any illegal activities or purposes
• Not use the Platform to promote, facilitate, or engage in any unlawful conduct

2.2 Age Requirements

You must be at least 18 years of age to create an account. By registering, you represent that you meet this age requirement.

3. Content License

3.1 User-Generated Content

By uploading, posting, or otherwise contributing any content to the Platform (including but not limited to text, images, files, club information, training schedules, posts, and forum contributions), you hereby grant Shooting Club a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content.

3.2 Content Ownership

You retain ownership of your content, but you acknowledge that the license granted above is indefinite and cannot be revoked, even after account termination or anonymization.

3.3 Content Responsibility

You are solely responsible for any content you contribute to the Platform. You represent and warrant that:

• You own or have the necessary rights to post the content
• The content does not violate any third-party rights
• The content complies with all applicable laws and regulations

3.4 Target Photos and Training Labels

When you upload a shooting target photo for scoring, you acknowledge and consent that the image and any labels you add (such as ring alignment and bullet hole positions) may be stored in a public training bucket. This allows you to view your photos later and enables us to improve scoring accuracy and related features.

4. Disclaimer of Warranties

4.1 "AS IS" Basis

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION

4.2 No Guarantee of Data Integrity

We do NOT guarantee:

• The security or integrity of any data stored on the Platform
• That backups will be available or accessible
• Protection against data loss, corruption, or deletion
• Availability of the Platform at any particular time
• That the Platform will meet your specific requirements

4.3 User Responsibility for Backups

5. Limitation of Liability

5.1 Full Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHOOTING CLUB, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR USE
• BUSINESS INTERRUPTION
• COST OF SUBSTITUTE SERVICES

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5.2 Maximum Liability

Our total liability to you for all claims arising from or relating to the Platform shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

6. Account Termination and Blocking

6.1 Our Right to Terminate

We reserve the absolute and unconditional right to:

• Suspend, block, or terminate any user account at any time
• Block, disable, or remove any club at any time
• Remove any content from the Platform

This right applies:

• Without prior notice
• Without providing a reason
• Regardless of whether you have paid for any services
• At our sole discretion

6.2 No Refunds

If your account or club is blocked or terminated, you are NOT entitled to any refund of fees paid, regardless of the reason for termination.

6.3 User-Initiated Deletion

Self-serve account deletion is not available due to legal retention requirements for invoices and financial records. If you want your personal data anonymized, you can email [email protected]. Content you have contributed remains subject to the license granted in Section 3.1.

7. European Union Compliance

For users in the European Union, these Terms of Service are governed by and interpreted in accordance with EU law where applicable. However, the limitations of liability and disclaimers above shall apply to the maximum extent permitted by EU consumer protection laws.

8. Payment and Fees

If we introduce paid features or subscriptions:

• All fees are non-refundable unless explicitly stated otherwise
• We reserve the right to change pricing at any time
• Continued use after price changes constitutes acceptance
• Payment does not guarantee uninterrupted service or protection from account termination

9. Intellectual Property

The Platform, including its design, code, features, and functionality, is owned by Shooting Club and is protected by international copyright, trademark, and other intellectual property laws.

10. Indemnification

You agree to indemnify, defend, and hold harmless Shooting Club and its affiliates from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you contribute to the Platform

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes are posted constitutes acceptance of the modified terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Belgium.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
